Introduction
Welcome to the Think Tank forum.Hyundai Motor America ("Hyundai") operates the Think Tank forum for the U.S. based community of Hyundai enthusiasts and owners.Through this service, Hyundai enthusiasts and owners who register as members can share knowledge, engage in discussions and submit feedback and suggestions to Hyundai, as well as receive news and information directly from Hyundai about its products and services.
By registering as a member of the Think Tank community, you agree to be bound by these Rules of Participation.Hyundai reserves the right to modify these Rules of Participation from time to time without notice. If you do not agree to all of the Rules of Participation, you may not use the Think Tank forum.
Hyundai may change, suspend or discontinue any feature of the Think Tank forum at any time, and may also impose limits on certain features and services or restrict access to parts of the Think Tank forum or the forum itself without notice.
These Rules of Participation constitute the entire agreement between you and Hyundai with respect to use of the Think Tank forum.
Registration and Account Creation
In order to participate in the Think Tank forum, you must create an account and become a registered member.In connection with such registration, you will be asked to provide certain information about yourself, a username and a password.However, once you create your profile, only your username, photograph, and your city and state will be viewable by other members.
Member Submissions
Hyundai welcomes and encourages feedback from Think Tank members.If you submit through the Think Tank forum, including through the moderator, a comment, suggestion, idea or proposal (a "Submission"), such Submission will not be kept confidential.Hyundai shall have no obligations to any Member concerning Submissions, contractual or otherwise, and shall not be liable for Hyundai's use or disclosure of any Submission. Hyundai shall be entitled to unrestricted use of the Submission for any purpose whatsoever, commercial or otherwise.You are solely responsible for ensuring that no Submission you make will infringe any intellectual property or proprietary rights of any third party, and you warrant that all Submissions you make will be non-infringing.
You hereby assign to Hyundai whatever intellectual property and proprietary rights you may have throughout the world in your Submissions to the Think Tank forum.
Member Conduct
Hyundai wants to ensure that all members of the Think Tank forum have a good member experience.By registering with the Think Tank forum, you agree to be respectful and helpful to other members. You are solely responsible for activities conducted under your account, and for keeping your password secure.Hyundai may in its sole discretion deny access to any registered member who:(i) creates multiple identities, (ii) appears to impersonate another person, (iii) adopts a username which infringes another's trademark rights or right of publicity, or which is offensive or objectionable, as determined by Hyundai in its sole discretion; or (iv) engages in disrespectful, threatening, off-topic or objectionable behavior in the Think Tank forum or otherwise as determined by Hyundai in its sole discretion.
Hyundai may, but is not obligated to, remove or edit, without notice, any content that Hyundai in its sole discretion deems to be unlawful, offensive, fraudulent, threatening, libelous, defamatory, or otherwise objectionable, which infringes or violates any other's intellectual property or other proprietary rights, or is otherwise in violation of these Rules of Participation.Hyundai reserves the right to terminate or temporarily refuse access to any registered member who violates these Rules of Participation.
Hyundai Intellectual Property
Think Tank forum content, including, but not limited to, written text, software, scripts, code, graphics, photos, sounds,music, videos and interactive features, as well as the trademarks, trade dress, service marks, and or logos displayed on the forum, are owned by or licensed to Hyundai, and are subject to all relevant intellectual property rights, including, but not limited to, copyright, trademark, trade secret, and/or patent protection in the United States and foreign jurisdictions, and any other intellectual property and proprietary rights under United States and/or foreign laws.
The content and information available on the Think Tank forum is for your personal, non-commercial use only, and may not be copied, transmitted, reproduced, distributed, sold, licensed, or otherwise exploited for any purpose whatsoever without the express prior written consent of Hyundai. Access to the Think Tank forum does not transfer to you ownership of any rights to the content contained therein.

Accordingly, Hyundai does not provide a mechanism for obtaining parental consent. If you are a parent or guardian and discover that your child has submitted his or her personally-identifiable information to Hyundai, Hyundai will take all reasonable efforts to delete the information from its database upon receipt of notice from you.
Indemnification and Disclaimer of Warranties
You agree to indemnify, defend and hold Hyundai, and its officers, directors, employees, agents, licensees, corporate affiliates and attorneys harmless from and against all claims, losses, expenses, damages and costs, including reasonable attorneys' fees, resulting from your violation of any of these Rules of Participation (including any intellectual property claims related to any Submissions you make), including, without limitation, any liability or expense arising from any claims, losses, damages (direct and/or consequential), suits, judgments, litigation costs, and attorney' fees, of every kind and nature.
THE THINK TANK FORUM, AND ANY CONTENT OR INFORMATION CONTAINED WITHIN IT OR ANY SERVICE OR ADVICE PROVIDED IN CONNECTION WITH THE FORUM, IS PROVIDED "AS IS" WITH NO REPRESENTATIONS OR WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT.HYUNDAI DISCLAIMS ALL WARRANTIES WITH RESPECT TO FORUM ACCESSIBILITY OR DOWN TIME.YOU ASSUME TOTAL RESPONSIBILITY AND RISK FOR YOUR USE OF THE FORUM.

Governing Law/Venue
Your use of the Think Tank forum and any dispute arising out of or relating to your use of the Think Tank forum will be governed by the laws of the State of California, irrespective of its conflicts of laws provisions. In the event that Hyundai wishes to pursue legal action against you, it may bring such legal action in any federal or state court having jurisdiction. Lawsuits against Hyundai arising out of or relating to your use of Think Tank must be brought in federal or state court in Orange County, California.
Termination
Hyundai may terminate your account at any time and for any reason. After your membership terminates, you may not use the Think Tank forum. All assignments, disclaimers, warranties, and indemnifications survive any termination of your membership.
Digital Millennium Copyright Act ("DMCA")
Hyundai respects the intellectual property of others, and expects Think Tank members to do likewise.With respect to content asserted to infringe the copyright rights of any party, Hyundai will comply with the United States Digital Millennium Copyright Act ("DMCA") and the Online Copyright Infringement Liability Limitation Act ("OCILLA"), 17 U.S.C. 101, 512.Upon receiving proper notification of an alleged infringement, Hyundai shall take steps to terminate access to the copyrighted material to the extent required by law.Information about Hyundai's designated agent with the Copyright Office to receive notification of claimed infringement may be found here: http://www.copyright.gov/onlinesp/agents/h/hyundai_motor.pdf .
